The lawsuit has been filed by Eastern LLC, the owner of a property near Leeds Pond. It is asking for a recent decision that would allow the Horvats to dump a large amount of fill in the area of the pond to be reversed. The Village of Plandome Manor is also listed in the suit. It had approved the application for the fill, stating that "the project received full approval from the New York State Department of Environmental Conservation (DEC) and stated that no work being done on the project affects the pond." Opponents of the development say the amount of fill is excessive and will damage the delicate ecosystem of the pond. The Horvats are asking for 350 cubic yards of fill. The Village allows a maximum of 50 without an application process.
While it's not exactly clear why the fill is needed, Horvat, whose name is listed in court documents as Bowie Horvat, recently put his Vancouver home on the market after being traded to the Islanders from the Canucks and then signing an eight-year extension with the team. According to the reports, public meetings took place before the decision was made to allow the project to go ahead. Horvat and his wife were not present, but sent legal representation on their behalf to each one.
