The NHL provided the following reasoning for the suspension.
Foote collects the pass in the neutral zone as Aube-Kubel comes back to defend the rush. Foote dumps the puck into the offensive zone after he does Aube-Kubel finishes a high, hard check that makes the head the main point of contact, on a hit where the contact was avoidable.
According to the league this hit satisfies both conditions of an illegal check to the head. The NHL provided these two reasons: The head is the main point of contact on the hit and if Aube-Kubel chose he could have avoided the hit.
