When the San Jose Sharks terminated Evander Jane's contract they'd received approval from the NHL. But that wasn't the end of the situation like they'd hoped. The Sharks claimed that Kane breached AHL COVID protocols and therefore felt they were justified in the move. Kane and his agent, Dan Milstein felt otherwise.

Kane immediately filed a grievance with the league and had his case heard. At this time the league is still yet to rule on the matter, but today it became very clear that there will not be a resolution between Kane and the Sharks.

While reaching a settlement would help both parties move on more quickly, it's become clear both parties are more concerned with being right. According to Daniel Nugent-Brown, an Oilers beat reporter neither side is willing to budge:

It sounds like both sides have dug in their heels with the Sharks determined not to pay him a cent and Kane eager to clear his name.

The ruling for Kane's case isn't expected before the regular season, but in the unlikely event that Kane is awarded back to the San Jose Sharks, it's likely that a trade would be facilitated between the two teams to return Kane to the Oilers.

There is an unlikely scenario where Kane wins the case and goes back to the Sharks then the Sharks would have to trade him to the Oilers which might cause him to miss some games, but again, this scenario is unlikely to happen.
